Terms and Conditions – Participating Establishments
1. Interpretation.
"Advertising Boxes" means the two (2) flashing adverts on every Participating Establishment with a Basic Listing’s unique web page portal.
"Account" means the number of Credits that a Participating establishment has in their account by which they can access services offered on the Website.
"Agreement" means the agreement which is formed between the Website and a Participating Establishment when a Participating Establishment registers with the Website and begins to use the Services provided by the Owners.
"Basic Listing" means the free listing on the Website that Participating Establishments can avail of when they successfully complete the registration process.
"Credits" means the units of currency utilised by Participating Establishments to purchase the Services provided by the Website.
"Customers" means the individual users of the Website who have successfully completed their registration with the Website and who use the Website to take advantage of the special offers, discounts and vouchers which are offered by the Participating Establishments on the Website.
"Customer Rating" means the information posted by Customers who have visited the Participating Establishment in the previous calendar month and who have decided to give a rating of their experience of the Participating Establishment to the Website.
"Owners" means Mealtime Limited (company number 479946).
"Participating Establishment" means the restaurants, bars, cafés, bistros, takeaways and pubs etc., who successfully complete the registration section of the Website and who are allocated by the Website their own unique webpage portal from which to advertise their Profile and their special offers, discounts etc.
"Premium Listing" means the six (6) month subscription fee paid by Participating Establishments to use the Services provided by the Website.
"Profile" means the public information displayed about the Participating Establishment on the Website and on each Participating Establishment’s unique webpage portal.
"Vouchers" means the vouchers purchased by Customer on the Website which are redeemable in the Participating Establisments.
"Website" means www.mealtime.ie

The Website is an online dining directory portal for Customers to access Participating Establishments’ Profiles
3. Listings
Participating Establishments that successfully register with the Website can avail of the following types of listings :-
Basic Listing – Free
Participating Establishments with a Basic Listing can list the following information for free :-

Profile
-
Menu
On successful registration, Participating Establishments with a Basic Listing will receive twenty one (21) free Credits which are valid for three (3) weeks from the date of registration. These Credits entitle the participating Establishment to promote and advertise on the Website at the following cost:-

Daily Specials – 1 Credit Per Day

Book a Table – 2 Credits Per Adult, 1 Credit Per Child Per Booking

Advertising – 1 Credit Per Advertising Box Per Day
Any of these twenty one (21) free Credits not utilised within the three (3) weeks time limit will lapse, are not refundable for cash and may not be transferred.
Basic Listing web page portals will contain Advertising Boxes.
Premium Listing – Paid
Participating Establishments with a Premium Listing can list the following information :-

Award & Accreditations
On successful registration, Participating Establishments with a Premium Listing will receive two hundred (200) free Credits which are valid for six (6) months from the date of registration. These Credits entitle the participating Establishment to promote and advertise on the Website at the following cost:-

Daily Specials – 1 Credit Per Day

Book a Table – 2 Credits Per Adult, 1 Credit Per Child Per Booking

Advertising – 1 Credit Per Advertising Box Per Day
Any of these two hundred (200) free Credits free Credits not utilised within the six (6) months time limit will lapse, are not refundable for cash and may not be transferred.
Premium Listing web page portals will not contain Advertising Boxes.
4. Advertising
The Website offers Participating Establishments the opportunity to advertise their information, details about their special offers, discounts, services etc. on the Website and through the use of Advertising Boxes on the unique web page portals of competing Participating Establishments who only have a Basic Listing.
5. Credits
After a Participating Establishment has successfully completed the registration process and has utilised their initial allocation of Credits (i.e. twenty one (21) for Basic Listings and two hundred (200) for Premium Listings, the Participating Establishment may purchase additional Credits at a cost of €1 per Credit subject to a minimum purchase of twenty euro (€20).
6. Vouchers
Customers of the Website may purchase vouchers on the Website. The Customer will pay the Website for the amount of the voucher and once validated, the voucher will be redeemable by the Customer in the Participating Establishment. Vouchers are only valid for three (3) months from the date of purchase. Participating Establishments must accept vouchers which have been validated by the Website. The Website will pay the Participating Establishment an amount representing 85% of the value of the voucher once the voucher.
7. Ratings
Only Customers who are registered members of the Website, who have purchased a voucher from the Website and who have redeemed that voucher in a Participating Establishment in the previous calendar month are eligible to give a Customer Rating.
The Customer Ratings include the following categories:-

Etc. etc. (together the "Categories)
The Customer will be given the option to rate their experience of the Participating Establishment by completing a short on line questionnaire on the Website.
The questionnaire will request the Customer to rate the Participating Establishment in each of the Categories by giving the Participating Establishment a number of stars out of five (5), with five (5) stars being the most and one (1) star being the least.
The Website will gather all Customers rating for all Participating Establishments at the end of each calendar month and at the beginning of the next calendar month, the Website will award the Participating Establishment with the highest number of stars with the award of "Best in Category".
The Best in Category award will be represented by a badge icon chosen by the Website which will be displayed by the Website on the Website and on the Participating Establishment’s own unique web portal page.
8. Profile
Profiles comprise all the public information that Participating Establishments choose to display on the Website and on their own unique webpage portal such as:
• name,
• address,
• contact details,
• photographs,
• menus
• special offers
• discounts etc.
9. Complaints by Customers
If the Website receives a complaint from a Customer about a Participating Establishment, the Website will have the option of discussing the complaint with the Participating Establishment and of commencing an investigation.
The Website in its absolute discretion may terminate a Participating Establishments registration on the Website and may remove the Participating Establishment’s Profile and unique web page portal from the Website. The Website reserves the right to make the ultimate decision on these matters because by registering with the Website, Participating Establishments are agreeing to be bound by these Terms & Conditions.
10. Miscellaneous
VAT
Unless they are expressly quoted as including VAT, all prices are exclusive of value added tax and other government taxes or duties.
Payment
Payment is collected from your credit/debit card or bank account at the time you become a Participating establishment.
Refund Policy
Where a Participating Establishment’s use of the Website is terminated for a breach of the Agreement, the Participating Establishment will be refunded within 21 days for the unused portion of their subscription period, minus any charges and administration costs incurred in issuing the refund.
Prices Quoted
Prices quoted are only valid during your browser session.
Queries and Complaints
Notification of queries or must be notified to the Website in writing (either by email to info@mealtime.ie or by post to No. 1 The Ramparts, Victoria Road, Rathgar, Dublin 6, Ireland) within twenty one (21) days of the issue arising, or within twenty one (21) days from the time the issue comes to the knowledge of the aggrieved party.
Warranties
The Website provides no warranties as the quality of the services or products provided by Participating Establishments to Customers. This is strictly a matter of contract law between the Participating Establishment and the Customer.
No Liability
The Website will have no liability to Participating Establishments or to a Customer for any services provided by a Participating Establishment to a Customer.
Consequential Loss etc.
The Website will not under any circumstances be liable to the Customer by reason of any representation or warranty, condition or other term or any duty of common law, or under the express terms of these terms, for any consequential, special, incidental or punitive loss or damage (whether for loss of current or future profits, loss of enterprise value or otherwise) and whether occasioned by our negligence, or that of our employees or agents or otherwise, even if advised of the possibility of such damages.
Entire Agreement
These terms expressly incorporate our Privacy Statement. Together, with the Terms & Conditions for the Customers, they contain the entire understanding and agreement between the Participating Establishment and the Customer relating to the sale of products and services to the Customer through this Website.
Governing Law
These terms and conditions and conditions of sale shall be governed by Irish law and subject to the exclusive jurisdiction of the courts of the Republic of Ireland.
